How Georgia tax sales work

Georgia sells property for unpaid taxes under a tax execution. The sale is advertised and held in the same manner as a judicial (sheriff's) sale: at the courthouse on the first Tuesday of the month between 10 a.m. and 4 p.m., after four weeks of newspaper ads, with at least ten days' written notice to the owner. The tax commissioner can also run the sale at the commissioner's office or another place named in the notice. That's why many counties, Fulton among them, call these sheriff's tax sales.

The high bidder receives a tax deed, but the owner (or anyone with an interest in the property) can redeem it within 12 months of the sale, and after that until the buyer forecloses the right of redemption by serving the statutory notice. To redeem, they pay the bid, any taxes the buyer paid after the sale, and a premium of 20% for the first year or part of a year, plus 10% for each year after that.

How Georgia foreclosure sales (sales under power) work

Georgia is a non-judicial foreclosure state: a security deed's power of sale lets the lender sell the property without going to court. A sale under power must be advertised and held at the time and place, and in the usual manner, of the county's sheriff's sales, which in Georgia means the courthouse on the first Tuesday of the month between 10 a.m. and 4 p.m.

The sale is advertised in the county's legal newspaper once a week for the four weeks before the sale, and the lender must send the debtor written notice at least 30 days before the sale date.

Lists of upcoming sales are published by the trustee law firms; LienDesk copies the firms' own lists. Sales are often postponed or cancelled the morning of the sale, so confirm with the firm before you go.
